EverBlade Designs provides artificial turf, putting greens, sports surfaces, hardscaping, related outdoor-design services, maintenance services, project consultations, warranty information, and other products and services.

The website allows visitors to learn about our services, request information, schedule consultations, submit project or warranty information, and communicate with EverBlade Designs.

Information on the website is provided for general informational purposes. Project specifications, pricing, timelines, warranties, cancellation terms, and payment obligations may be governed by a separate written proposal, estimate, order, or project agreement.

2. Privacy

Your use of the website is subject to our Privacy Policy, which explains how we collect, use, protect, and disclose personal information.

Merely using this website or accepting these general Terms does not constitute consent to receive marketing text messages.

3. Electronic Communications

4. EverBlade Designs Text Messaging Program

Program Description and Consent

EverBlade Designs may offer an SMS and MMS text messaging program through which customers and prospective customers can receive communications concerning:

• Consultation and quote requests;
• Appointment scheduling and reminders;
• Project, installation, delivery, and service updates;
• Customer-service and warranty communications;
• Account or transaction-related notifications; and
• Promotional offers or marketing communications when the recipient has separately consented to receive them.

You will receive text messages only after providing affirmative consent through an EverBlade Designs form, text-message keyword, written agreement, or another disclosed opt-in method.

By opting in, you authorize EverBlade Designs to send recurring SMS or MMS messages to the mobile number you provide. Messages may be sent using an automatic telephone dialing system or other automated technology.

Consent to receive marketing text messages is not a condition of purchasing any product or service. A website form’s SMS consent option must be voluntary and must not be preselected.

Message Frequency

Message frequency varies depending on your interactions with EverBlade Designs, the services you request, and the type of messaging program in which you enroll.

Message and Data Rates

Message and data rates may apply. Your mobile carrier’s message, data, and other charges may apply to messages sent or received under the program.

Opting Out

Reply STOP to any EverBlade Designs text message to unsubscribe.

You may also use another reasonable method of communicating that you no longer want to receive text messages. After opting out, you may receive one final confirmation message. No additional messages will be sent unless you subsequently provide new consent or the message is otherwise permitted or required by law.

Where supported, additional opt-out keywords may include END, CANCEL, UNSUBSCRIBE, and QUIT.

Mobile Information and Consent

EverBlade Designs does not sell, rent, or share mobile telephone numbers, text-message opt-in data, or text-message consent with third parties or affiliates for their own marketing or promotional purposes.

Text-message opt-in data and consent are excluded from any other provision of these Terms that permits information sharing.

We may disclose mobile information to telecommunications carriers, messaging platform providers, and other service providers solely as necessary to operate the messaging program, deliver requested messages, prevent fraud or misuse, maintain records, or comply with applicable law. These providers are not permitted to use that information for their own marketing purposes.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is not guaranteed by EverBlade Designs.

Eligibility and Mobile Number Changes

You must be the subscriber or authorized user of the mobile number provided. If your mobile number changes or is reassigned, you agree to opt out or notify EverBlade Designs before discontinuing use of the number.

5. Children

The website and messaging program are not directed to children under 13, and EverBlade Designs does not knowingly collect personal information from children under 13.

Individuals under 18 may use the website only with the permission and supervision of a parent or legal guardian.

6. Project Cancellations and Refunds

Cancellation, rescission, deposit, and refund rights may be governed by the written agreement applicable to a particular project and by applicable law.

Where the existing EverBlade project cancellation policy applies, a customer may cancel a qualifying transaction before midnight on the third business day following the transaction. For cancellations after an applicable three-business-day rescission period, deposits may be subject to a 40% cancellation charge. After 30 days, deposits may become nonrefundable.

Unless a written project agreement states otherwise, deposit funds may be applied to another project at the same address within six months after the original agreement is signed. If construction has not begun within six months, the deposit may be forfeited and EverBlade may have the option to terminate the project agreement.

If this section conflicts with a signed project agreement or a mandatory right provided by applicable law, the signed agreement and applicable law will control.

7. Third-Party Websites and Services

The website may contain links to third-party websites. EverBlade Designs does not control and is not responsible for the content, availability, security, or privacy practices of third-party websites. A link does not imply endorsement or association.

Some website features or services may be provided by contractors or third-party service providers. EverBlade may provide these parties with information reasonably necessary to perform the requested service, subject to our Privacy Policy.

Notwithstanding the foregoing, mobile telephone numbers and text-message opt-in data or consent will not be shared with third parties or affiliates for their own marketing or promotional purposes.

8. Acceptable Use and Intellectual Property

EverBlade Designs grants you a limited, nonexclusive, nontransferable, and revocable license to access and use the website for lawful personal or business purposes consistent with these Terms.

You may not:

• Use the website for an unlawful or prohibited purpose;
• Interfere with the website’s operation or another person’s use of it;
• Attempt to obtain information through means not intentionally provided;
• Introduce malware or harmful code;
• Reverse engineer website software except where expressly permitted by law; or
• Copy, publish, sell, distribute, or commercially exploit website content without authorization.

Unless otherwise stated, website text, graphics, photographs, logos, designs, software, and other content are owned by or licensed to EverBlade Designs and are protected by applicable intellectual-property laws. No ownership rights are transferred to you through your use of the website.

9. International Users

The website is operated from the United States. If you access the website outside the United States, you are responsible for complying with the laws applicable in your location.

10. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless EverBlade Designs and its officers, employees, contractors, agents, and service providers from losses, liabilities, costs, and reasonable attorneys’ fees arising from your unlawful use of the website, violation of these Terms, or infringement of another party’s rights.

EverBlade reserves the right to assume control of the defense of any matter subject to indemnification, in which case you agree to provide reasonable cooperation.

11. Arbitration

Except where prohibited by law, disputes arising out of these Terms or use of the website that cannot be resolved informally will be resolved through final and binding individual arbitration under the Federal Arbitration Act.

Arbitration will be conducted by one neutral arbitrator through the American Arbitration Association or another mutually agreed arbitration service. The arbitrator may award any relief available in an individual court proceeding, subject to applicable law.

The arbitrator will determine issues concerning the interpretation, scope, and enforceability of this arbitration provision. Judgment on an arbitration award may be entered in a court with jurisdiction.

12. Class-Action Waiver

To the fullest extent permitted by law, arbitration and other proceedings will be conducted only on an individual basis.

Neither party may bring or participate in a class, collective, consolidated, or representative action against the other. The arbitrator may not consolidate claims from more than one person unless both parties agree or applicable law requires otherwise.

13. Disclaimer of Warranties

The website and its content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, EverBlade Designs disclaims warranties concerning the accuracy, reliability, availability, merchantability, fitness for a particular purpose, title, and noninfringement of website content and functionality.

Product, installation, workmanship, or service warranties will be governed by the applicable written warranty or project agreement.

14. Limitation of Liability

To the fullest extent permitted by law, EverBlade Designs and its suppliers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of or inability to use the website.

Some jurisdictions do not permit certain warranty exclusions or liability limitations. In those jurisdictions, the exclusions and limitations will apply only to the maximum extent permitted by law.

15. Termination

EverBlade Designs may restrict or terminate access to the website when reasonably necessary to protect the website, enforce these Terms, comply with law, or prevent fraud, misuse, or security threats.

16. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where federal law or another jurisdiction’s mandatory consumer-protection law applies.

17. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, it will be modified or limited to the minimum extent necessary, and the remaining provisions will remain in effect.

These Terms, together with the Privacy Policy and any applicable signed project agreement, constitute the agreement governing the matters addressed herein. A signed project agreement will control if it expressly conflicts with these website Terms concerning a specific project.

18. Changes to These Terms

EverBlade Designs may update these Terms when its services, messaging practices, business operations, or legal obligations change.

The revised version will be posted on this page with a new effective date. Changes will apply prospectively unless applicable law permits otherwise.
